Welcome to montereybayrugby.org (the "Site"), operated by Monterey Bay Rugby Association ("MBRA," "we," "us," or "our"), a 501(c)(3) nonprofit organization. These Terms of Service ("Terms") govern your use of the Site. By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
Who May Use the Site
The Site is intended for general audiences. If you are under 18, you may use the Site only with the involvement of a parent or guardian. Registration and interest forms concerning a minor must be completed by that minor's parent or legal guardian.
Use of the Site
You may use the Site for lawful, personal, and informational purposes and to engage with MBRA's programs. You agree not to:
use the Site in any way that violates applicable law or these Terms;
interfere with or disrupt the Site's operation or security;
attempt to gain unauthorized access to any part of the Site or its systems;
submit false, misleading, or fraudulent information; or
use the Site to harass, harm, or impersonate others.
Forms and Registration
When you submit information through the Site — including youth interest and registration forms — you agree to provide accurate and complete information and, where the information concerns a minor, confirm that you are that minor's parent or legal guardian and consent to its submission. Your submissions are handled as described in our Privacy Policy.
Donations
Donations made through the Site are voluntary and support MBRA's charitable mission. MBRA is a 501(c)(3) nonprofit organization (EIN 33-1852794); donations may be tax-deductible to the extent allowed by law, and you should consult your tax advisor. Payments are processed by our third-party payment processor, West Coast Community Bank, subject to its terms. Donations are generally non-refundable; contact us at simon.nicholls@outlook.com with any questions about a donation.
Program Participation and Assumption of Risk
Information on the Site about rugby programs, clinics, and events is provided for general purposes. Rugby is a contact sport that involves inherent risks of injury. Participation in any MBRA program is governed by the separate registration agreements, waivers, and medical/liability releases provided during enrollment — not by these Terms. These Terms and the Site do not create any right to participate and are not a substitute for those participation agreements.
Intellectual Property
The content on the Site — including text, graphics, logos, images, and the MBRA name and marks — is owned by or licensed to MBRA and is protected by applicable intellectual property laws. You may view and share Site content for personal, non-commercial purposes, but you may not copy, modify, distribute, or use it commercially without our prior written permission.
User Submissions
If you submit content to us (for example, photos, comments, or messages), you grant MBRA a non-exclusive, royalty-free license to use it in connection with our mission and communications, consistent with our Privacy Policy. Please do not submit content you do not have the right to share. Photographs of minors are used only consistent with the consents obtained during registration.
Third-Party Links and Services
The Site may link to or rely on third-party websites and services (such as our donation platform, analytics, and social media). We do not control and are not responsible for their content, practices, or terms. Your use of those services is at your own risk and subject to their terms.
Disclaimers
THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that information on the Site is complete or current.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MBRA AND ITS DIRECTORS, OFFICERS, VOLUNTEERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE.
Indemnification
You agree to indemnify and hold harmless MBRA and its directors, officers, volunteers, and agents from any claims, damages, or expenses arising out of your use of the Site or violation of these Terms.
Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute relating to the Site or these Terms will be brought in the state or federal courts located in Monterey County, California.
Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
